Jussa claims CCM main violator of the Constitution

Dodoma. Ruling CCM was yesterday accused of violating the Constitution Review (Amendment) Act, 2013 by sticking to its guns on the two-government Union in the new Katiba writing process.
A Member of the Constituent Assembly (MCA), Mr Ismail Jussa Ladhu, said this when tabling a report of minority side of the CA Committee Number Six on Chapters One and Six of the second Draft Constitution.
The law puts in place an entire procedure of obtaining the second Draft Constitution, including the formation of the Constitutional Review Commission (CRC) tasked to collect views from the people to prepare the Draft, he said.
Institutions and District Constituent Assemblies were then created to discuss the first Draft Constitution ready for the CRC to come up with the second Draft.
“We’re surprised to see the two-tier Union government structure proposal is debated in this House. Where does it come from? Isn’t it the views of the people that are supposed to be in the second Draft Constitution?” he asked.
Mr Jussa said the two-tier Union government model proposal could only be deliberated on if a fresh commission is tasked to collect views of the people pertaining to it, which is not stipulated in the second Draft Constitution.
But more important, he said, is that the self-proclaimed majority MCAs, who are actually the minority outside the House, accuse proponents of the three-tier Union model of inviting Sultan (Seyyid) Jamshid (bin Abdullah) once again.
This is a serious allegation, he said. “I ask myself, on January 12, 2000, at Aman Stadium before former President Benjamin Mkapa; the former Zanzibar President, Dr Salmin Amour, pardoned Sultan Jamshid and welcomed him back if he was ready. Whose party was Dr Salmin,” he queried.
He (Dr Salmin) promised to give him (Sultan) every support he needed to return to Zanzibar. The statement, which has not been refuted to date, shows that if there was anyone intending to welcome back the Sultanate, it was CCM, he said.
If whoever proposes the three-tier Union model invites the Sultanate; did the former Zanzibar President, Mr Abood Jumbe, who demanded the same in 1984, intended to invite Sultan Jamshid?

Dodoma. The government yesterday firmly attempted to clear the mystery surrounding the Union between Tanganyika and Zanzibar by vowing to submit the Articles of Union to the Constituent Assembly (CA) chair tomorrow.
“Articles of the Union are in place and in good condition just as they were in 1964,” the minister of State in the President’s Office (Coordination and Relations), Mr Stephen Wassira, told the Assembly.
Mr Wassira said shortly before he tabled a report of the CA Committee Number Six on Chapters One and Six of the second Draft Constitution that he was speaking on behalf of the government.
He assured Members of the Constituent Assembly (MCAs) that the Father of the Nation, Mwalimu Julius Nyerere, and the first President of Zanzibar, Abeid Aman Karume, did actually append their signatures to the Articles of Union in question.
A heated debate emerged in the House lately on whether the Articles of Union, which serve as the birth certificate of the merger between Tanganyika and Zanzibar ever existed.
The UN reportedly refuted allegations that it had a copy of the same, saying the organisation would have issued a certificate to the United Republic of Tanzania to acknowledge receipt.
The CA member Tundu Lissu earlier laboured to prove in the House that the Articles of Union were illegal if not inexistent, provoking his colleague, Mr Peter Serukamba, who queried “who are we here if the Union is non-existent?”
Mr Lissu was clarifying on a report by the minority of the CA Committee Number Four on Chapters One and Six of the second draft constitution.
He said a number of documents indicating the Articles of the Union were nonexistent were available, but most of the witnesses of the 1964 signing ceremony dubiously died.

Alisema wanachokifanya wajumbe wa CCM ni kupuuza maoni ya Tume ya Jaji Joseph Warioba ili waendelee kutengeneza Katiba ya kukaa mahali na kulipana rushwa.
Dodoma. Mjumbe wa Bunge Maalumu la Katiba, Felix Mkosamali (pichani chini), jana alirusha tuhuma kwa Rais Jakaya Kikwete na Spika wa Bunge Muungano, Anne Makinda akidai kuwa ni viongozi vigeugeu kutokana na kutaka mfumo wa serikali mbili.
Kutokana na hilo, Mkosamali alipendekeza wajumbe wote wanaopinga mfumo wa serikali tatu, wabebe mabegi yao na kuondoka bungeni kwa kuwa hawako tayari kuona katiba inatungwa ya CCM pekee.
Alitoa kauli hiyo alipokuwa akitoa mchango wake kwenye Rasimu ya Katiba katika Sura ya Kwanza na Sura ya Sita ambayo wajumbe walianza kuchangia jana.
Hata hivyo, Mwenyekiti wa Bunge, Samuel Sitta alimtaka mjumbe huyo kufuta kauli yake ya viongozi vigeugeu ili kupunguza kelele za wajumbe ambao walianza kuzomea kuwa alikuwa anakiuka kanuni.
Mkosamali ambaye ni Mbunge wa Kibondo (NCCR-Mageuzi), alisema kuwa nchi ya Tanzania haitasonga mbele kutokana na kuongozwa na watu ambao ni vigeugeu.
Aliwatuhumu viongozi hao kuwa wamekuwa wakitenga fedha nyingi kwa ajili ya kufanya propaganda za kulipana posho huku wakilitupa na kulisahau Azimio la Arusha ambalo lilikuwa na maadili mema.
Alisema wanachokifanya wajumbe wa CCM ni kupuuza maoni ya Tume ya Jaji Joseph Warioba ili waendelee kutengeneza Katiba ya kukaa mahali na kulipana rushwa.
“Mnajifungia ndani watu wawili mnaandika maoni yenu kisha mnaleta yanakuwa ni maoni ya kukariri, mnapopuuza maoni ya wananchi kwa serikali tatu, hizo mbili mlipata maoni ya watu gani?” alisema.
Mapema jana Asha Bakari Makame, nusura achafue hali ya hewa bungeni wakati akichangia kwenye rasimu hiyo baada ya kuanza kumshambulia Ismail Jussa kwamba analazimisha muundo wa serikali tatu ambao hautawezekana.

Save Ngorongoro Crater from further destruction

You can’t eat your cake and have it, so goes an old adage. This could be said about the situation unfolding in our country right now, especially in the Northern Tourist Circuit.

This comprises Tanga, Kilimanjaro, Arusha, Mara and Mwanza. It is a fact that much of the revenue from Tanzania’s tourism sector has for a long time come from this circuit.

Such tourist destinations as Mt Kilimanjaro, Serengeti, Manyara and Ngorongoro Crater, to name but a few, have attracted close to a million tourists to Tanzania each year.

But now a problem has arisen in Ngorongoro Crater. It is to do with the number of motor vehicles going down to the crater. It has been realized that the 400 motor vehicles descending the crater’s 610-metre deep steep walls are just too many.

The Ngorongoro Conservation Area Authority (NCAA) is therefore looking into ways of reducing motor vehicles entering the crater, which is the world's sixth largest unbroken caldera.

According to Dr Freddy Manongi, the NCAA chief conservator, tourists have complained that there are too many motor vehicles descending the crater.

It is now attracting more than 500,000 tourists annually and generating an average 55bn/- in revenue, the target being over 60bn/- this year. They say the vehicles distract them from enjoying the natural scenery and wildlife.

Granted, this has resulted from the NCAA’s continued climb in the popularity charts of the global travel industry, but something needs to be done to stop this denudation of the area. And, as the customer is always right, something should be done to heed to the tourists’ complaints.

Going by the NCAA’s own vision, the issue of preservation of the crater is paramount: “An overall tourism strategy for the property is a long term requirement, to both guide the public use of the property and ways of presenting the property, and to prioritize the quality of the tourism experience, rather than the quantity of visitors and tourism facilities.

Vehicle access to the crater and other popular areas of the property requires clear limits to protect the quality of experience of the property.”

Ngorongoro has paleontological and archaeological sites over a wide range of dates. The four major sites are Olduvai Gorge, Laetoli site, Lake Ndutu site and the Nasera Rock Shelter. The variety and richness of the fossil remains, including those of early hominids, has made it one of the major areas in the world for research on the human evolution.

The NCAA has to now translate its tourism strategy, balancing between the quest for more revenue from tourism and preservation of the crater’s ecology, so crucial to understanding the evolution of human beings. How to balance the equation is a headache for every stakeholder in the tourism industry.

Be that as it may, however, a solution has to be found to this challenge facing the crater. We go by the suggestion of Manongi that it is high time the NCAA looked into the promotion of other attractions within Ngorongoro.

These include other caldera, the beautiful Empakai Crater, the historic Olduvai Gorge and Laetoli sites where the first human being lived.

Mjadala wa sura ya kwanza na ya sita za Rasimu ya Katiba, ulianza jana jioni kwa baadhi ya wajumbe kuzungumza kwa hisia kali, mipasho, matusi na kukashifiana.

Miongoni mwa waliozungumza kwa hisia kali na ni Dk. Hamis Kigwangalla, (pichani) ambaye alizishutumu tume zote, ambazo ziliwahi kuundwa kwa ajili ya kukusanya maoni kuhusu muundo wa Muungano.

Dk. Kigwangalla alidai kuwa tume hizo za ujanja ujanja na kinyemela na ndiyo maana zilipendekeza muundo wa serikali tatu.

Alisema mapendekezo ya tume zote ya Jaji Nyalali, Jaji Kisanga na ya Jaji Warioba wake uhalali unakosekana.

Alitoa mfano kuwa tume ya Nyalali iliyoundwa mwaka 1990 ilikuwa ya ujanja ujanja na na kinyemela na kwamba, haikuwa na uhalali kutokana na wajumbe wake kugawanyika,

Alidai kutokana na mgawanyiko, wajumbe walishindwa kuafikiana na kumlazimisha Mwenyekiti, Jaji Nyalali kupiga kura ya turufu ya kuamua pamoja na kuwa alikuwa na msimamo wa serikali tatu.

Kigwangalla pia alidai kuwa tume hizo zilikuwa zinawaita watu wachache na kuwahoji faragha na kwa usiri na kutoa mfano kuwa Tume ya Jaji Kisanga walikuwapo Nyalali,
Kificho na Mwanasheria Mkuu wa kwanza wa Zanzibar, Walfang Dourado, na walichokipata ni kile kile kwa kuwa kila mmoja alikuwa na upande wake.

Aliongeza kuwa mwendelezo wa tume hizo ni kuvuruga na limekuwa ni tatizo nchini.

Wakati akiendelea kuzishutumu tume hizo, Mjumbe John Mnyika aliomba fursa ya kutoa taarifa na kufafanua kuwa tume ya Nyalali ilikuwa na wajumbe 22 na kwamba, wajumbe 13 waliunga mkono serikali tatu na tisa hawakukubali.

“Wajumbe 13 walipendekeza serikali tatu na tisa serikali mbili na siyo kweli kuwa Mwenyekiti Nyalali alipiga kura ya turufu,” alisema Mnyika.

Mjumbe mwingine aliyechangia kwa hisia kali, ni Felix Mkosamali, ambaye aliwashambulia baadhi ya viongozi wakuu wa kitaifa kwamba, ni vigeugeu akidai kuwa baadhi yao waliwasilisha maoni ya taasisi zao katika tume ya Warioba wakipendekeza serikali tatu, lakini ghafla wamegeuka na kutetea serikali mbili.

MATUSI YA NGUONI
Mjumbe Asha Bakari wa kundi la walio wengi, alianza kumsakama mjumbe Ismail Jussa Ladhu kwa matusi makali.

Alimweleza Jussa kuwa CCM haitakubali Serikali ya Mapinduzi Zanzibar (SMZ) ichukuliwe, kwani haikupatikana kwa karatasi ni nchi iliyopinduliwa.

“Namwambia Jussa kuwa si kweli kuwa anaionea huruma nchi hii,” alisema na kuongeza kwa Kipemba hawa ni “wasaidaka si wapundaka bali ni wapumbaka,” alisema na Bunge kuhitaji tafsiri, ndipo akaeleza kuwa maana yake ni asiye na fadhila hafadhiliki naye ni Jussa.

Mjumbe huyo alidai kuwa Jussa alisomeshwa na SMZ kwenye vyuo vikuu vya Tanzania, lakini Jussa alipinga kuwa alisoma Uingereza.

Kugombana huko kulisababisha kuwapo maombi mengi ya mwongozo mengi yakimtetea Jussa.

Watu 17 wamejeruhiwa vibaya na kitu kinachosadikiwa kuwa ni bomu, wakati wakiangalia mpira katika baa ya Night Park na kati yao 11 wamelazwa Hospitali ya Mkoa wa Arusha ya Mount Meru, mmoja Hospitali ya Selian, huku watano wakiruhusiwa baada ya kupatiwa matibabu.

Aidha, kati ya hao 11 walioko Mount Meru, mmoja hali yake ni mbaya kutokana na kusagika mfupa mmoja na uongozi wa hospitali hiyo unafanya mawasiliano na Wizara ya Afya na Ustawi wa Jamii ili kujua kama anaweza kuhamishiwa hospitali ya rufaa.

SHUHUDA ALONGA

Akizungumza kwenye wodi ya majeruhi katika Hospitali ya Mount Meru, Obeid Mbasha, alisema alikwenda kwenye baa hiyo kuangalia mpira wa Ulaya, ilipofika majira ya kati ya saa 1:30 au saa 2:00 usiku, alisikia mlio mkubwa na alipoangalia aliona watu wamelala chini wengine wakilia na huku baadhi yao wakikimbia.

“Hapo nami nikainuka kutaka kukimbia. Sikuweza, nikaanguka chini. Mara nikaanza kusikia maumivu kwenye goti, kushika damu zinanitoka. Na baada ya muda mfupi walikuja watu kunibeba na kunipeleka hospitalini,” alisema.

MAJERUHI ANENA

Kwa upande wake, mmoja wa majeruhi waliopatwa na mkasa huo, ambaye hakutaja jina lake, alisema alikuwa akiangalia mpira, ghafla alisikia kishindo kikubwa kilichoambatana na moshi, hali ambayo iliwastua na kujikuta wakiwa wameumia.

MHUDUMU WA BAA AZUNGUMZA

Mmoja wa wahudumu wa baa hiyo, Aneth Mushi, alisema yeye alikuwa amekwenda jikoni kuchukua chakula ili awapelekee wateja wake waliomwagiza.
Alisema wakati akibeba sahani, ghafla alisikia kishindo na kelele za watu, alipoona hivyo alimwaga chakula na kukikmbia.

“Kwa kweli nasikitika sana. Watu wameumia na mimi ni Mungu tu kaniokoa, vinginevyo nami ilikuwa ni mmoja wa majeruhi,” alisema.

MGANGA MKUU ATHIBITISHA HOSPITALI KUPOKEA MAJERUHI

Mganga Mkuu wa Mkoa wa Arusha, Dk. Frida Mokiti, akizungumza baada ya kutembelea majeruhi, alisema Hospitali hiyo ya Mkoa walipokea majeruhi 17, ambao kati yao mmoja alikwenda Selian na watano waliruhusiwa baada ya kutibiwa.

“Lakini hapa Mount Meru wamebaki 11, ambao kati yao wanaume nane na wanawake watatu ila majeraha yao makubwa yapo miguuni na kwenye mapaja,” alisema.
Dk. Mokiti alisema hata hivyo, mgonjwa mmoja, ambaye hakumtaja jina lake, alisema hali yake siyo nzuri, kwani ameumia sana na kusagika mfupa mdogo, hivyo wanafanya mawasiliano na watu wa wizara hiyo wapate maelekezo ya kufanya au kama kumhamisha hospitali watajua.

MAJERUHI WATAJWA
Dk. Motiki alitaja majina ya majeruhi katika hospitali hiyo kuwa ni Christian Mmasi, Ally Sudi, Evarest Kaaya, Evance Maleko, Pius Shayo na Peter Mkereme.
Wengine ni Obeid Mbasha, Anterius Mganda, Loice John, Suzan Jacob na Joyce William.

MKUU WA MKOA ALONGA

Naye Mkuu wa Mkoa wa Arusha, Magesa Mulongo, akizungumza na waandishi wa habari katika eneo la tukio, alisema lilitokea majira ya saa 2:00 usiku wakati watu wakiwa wanaangalia mpira.

Alisema wakati wakiendeele kuangaliwa mpira, walisikia kishindo kikubwa na kinachosadikiwa kuwa ni bomu la kutengenezwa kwa mujibu wa taarifa za awali.

MGANGA WA ZAMU

Mganga wa zamu katika Hospitali ya Selian mkoani Arusha, Dk. Peter Mabula, alisema amepokea majeruhi mmoja na hali yake inaendelea vizuri.

KAMANDA WA POLISI AKATAA KUZUNGUMZA

Hata hivyo, Kamanda wa Polisi Mkoa wa Arusha, Liberatus Sabas, aliyekuwa eneo la tukio muda mwingi na kikosi cha ukaguzi wa mabomu, alisema hawezi kuzungumza chochote.

MKURUGENZI WA BAA
Mkurugenzi wa Baa hiyo, Joseph Karugendo, alisema wafanyakazi wake saba ni miongoni mwa majeruhi wa tukio hilo na kwamba, lilipigwa katikati ya mlango mkuu wa kuingia ndani ambako pia kumefungwa turubai.

“Hatuna wasiwasi wa kutokupatikana kwa aliyefanya tukio hilo, kwani tumefunga mitambo ya kamera ya CCTV. Baada ya tukio, polisi walizingira mtambo huo ili kuhakikisha hauvurugwi. Umelindwa hadi asubuhi,” alisema Karugendo.

Aliongeza kuwa: “Asubuhi polisi pamoja na mtu wetu mmoja wameondoka na mtambo huo kwa ajili ya kwenda kuupitia. Tuna uhakika kuwa monitor hiyo ya CCTV siyo rahisi kuchezewa.”

Alisema hadi sasa hawajui wamepata hasara kiasi gani, kwani eneo hilo linalindwa na polisi hadi sasa na kuwa baadhi ya vitu vilivyoharibika vikiwa ni pamoja na meza, viti, makabati ya chakula pamoja na malipo ya vinywaji na chakula.

WAZIRI CHIKAWE: UCHUNGUZI UNAFANYIKA
Waziri wa Mambo ya Ndani ya Nchi, Mathias Chakawe, alisema waliojeruhiwa ni watu 12 katika tukio hilo na kwamba, bomu hilo lilitegwa na mtu asiyefahamika kwenye baa hiyo.

Chikawe alisema hayo bungeni mjini Dodoma jana na kusema serikali yake katika kukabiliana na hilo imewaagiza wapelelezi katika eneo la tukio kufanya uchunguzi na kwamba, baada ya kazi yao kukamilika watauarifu umma.

NI MWENDELEZO WA MABOMU ARUSHA
Tukio hilo limetokea miezi 10 baada ya mlipuko wa bomu kutokea katika viwanja vya Soweto, jijini humo, Juni 14, mwaka jana na kuua watu wanne na wengine karibu 100 kujeruhiwa kati yao vibaya.

Mlipuko huo ulitokea wakati Mwenyekiti wa Taifa wa Chama cha Demokrasia na Maendeleo (Chadema), Freeman Mbowe, akimalizia hotuba yake ya kufunga kampeni za chama chake na huku wanachama wakijiandaa kufanya harambee.
Mkutano wa Chadema ulikuwa wa kuhitimisha kampeni za uchaguzi mdogo wa madiwani kwa kata za Themi, Elerai, Kaloleni na Kimandolu.

Mlipuko huo ulitanguliwa na ule uliotokea katika Kanisa Katoliki la Mtakatifu Joseph Mfanyakazi Parokia ya Olasiti, Mei 5, mwaka jana.

Mlipuko huo ulitokea wakati Balozi wa Vatican nchini, ambaye ni mwakilishi wa Baba Mtakatifu Francis, Askofu Mkuu Francisco Padilla, akiongoza misa ya uzinduzi wa parokia hiyo akishirikiana na Askofu Mkuu wa Jimbo Kuu la Arusha, Josephat Lebulu.
Katika mlipuko huo watu watatu walifariki dunia na zaidi ya 70 kujeruhiwa kati yao vibaya.
